1. Who these terms are with

These terms are between you and Tro Mirzaian, 100 Echo Point, Scarborough, Ontario M1W 2V2, Canada ("we"). They cover the AniMates app, AniMates Plus, AniMates accounts and this website. By installing AniMates or making an account, you agree to them. Our privacy policy explains what we do with your information.

2. Using AniMates

• We give you a personal, non-exclusive, non-transferable licence to install and use AniMates on computers you own or control, for your own use.
• The scenes, characters and artwork are ours. You can share pictures, postcards and clips you make with Keep this moment, for personal, non-commercial use. You may also show them on streams and in videos, including ones that earn money, as long as you credit AniMates. You may not sell them or put them on merchandise.
• Please don't copy, resell, or reverse engineer the app or its art, or get around the licence check.

3. The free trial and AniMates Plus

• New installs get everything in AniMates Plus for 14 days. After that, the free features keep working.
• AniMates Plus is sold by our reseller, Lemon Squeezy, as merchant of record: Lemon Squeezy is the seller on your receipt, takes the payment and handles sales tax. Lemon Squeezy's terms of sale apply to the purchase, the payment and tax.
• Plus comes two ways, at the prices shown at checkout:
  • A subscription (monthly or yearly) that renews until you cancel. Cancel any time from the link in your Lemon Squeezy receipt; Plus then stays on until the end of the period you've paid for, and isn't renewed.
  • Lifetime: one payment, and Plus for as long as AniMates is offered. If AniMates ever closes, we'll give at least 12 months' notice and release a final update that keeps Plus working on your PCs without our servers, so everything that runs on your PC keeps running. Features that need our server, such as friends and sync, would stop.
• One licence covers 3 PCs at a time, and every device signed in to the account it's on. If you buy with the email of your AniMates account, Plus arrives on that account by itself once the email is confirmed.
• The app checks your licence with Lemon Squeezy every few days, and keeps working offline for 14 days after the last good check. When a subscription ends or a payment is refunded, Plus turns off, and the free features keep working.
• Refunds go through Lemon Squeezy: write to support@animates.me or answer your receipt. We give a full refund within 30 days of a purchase or renewal, no questions asked. This doesn't affect any rights you have under the law where you live.
• We may change the price for new purchases and future renewals. We'll tell subscribers before a change reaches them, so you can cancel first.

4. Accounts

• You need to be 13 or older, or 16 where local law requires it, to make an account.
• Keep your sign-in details to yourself. You're responsible for what happens in your account, and tell us straight away if someone else gets in. You can see your signed-in devices, and sign them out, in the app.
• You can download everything your account keeps ("Download my data") at any time.
• Deleting your account: you can delete it at any time in the app. Your account, synced settings, your own notes and photos, friends, and everything you shared are deleted at once (and from our backups within 14 days), as our privacy policy explains. Deleting the account doesn't cancel a subscription, which is billed by Lemon Squeezy: cancel it there too. Your licence key keeps working on its own, and you can paste it into the app or a new account.

5. Sharing notes and photos with friends

AniMates lets you send notes and photos to friends you've added. What you send stays yours. You give us the permission we need to store it and deliver it to the friends you chose, and nothing more. We don't use it for advertising or to train AI.

The same goes for replies, answers to the daily question, and your display name. Please only share things you have the right to share, and never:

• anything that sexualises children, which we report to the authorities
• harassment, threats, or hate against people for who they are
• intimate images of someone without their consent
• other people's private information without their permission
• spam, scams, malware, or anything illegal where you or your friends live

Anyone can block or report you. We look at reports, and we may remove content, limit sharing, or close an account that breaks these rules, telling you why unless the law or someone's safety stops us. If you think we got it wrong, write to support@animates.me and a person will look again.

6. Weather and other services

Weather comes from Open-Meteo, a free service we don't run. It's for setting the scene, not for planning around storms: we can't promise it's accurate or always there.

7. Updates and changes

AniMates updates itself from our website so you get fixes and new places. We may add, change or retire features. If we take away something you paid for in Plus, we'll tell you first and offer a fair refund.

8. If something goes wrong

We work hard to keep AniMates light and safe on your PC, but it's provided "as is", without warranties beyond those the law requires. As far as the law allows, we aren't liable for indirect losses, and our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing here limits liability that can't be limited by law, such as for death or injury caused by negligence, or fraud.

9. Ending these terms

You can stop at any time by uninstalling AniMates and deleting your account. We may end these terms for someone who seriously or repeatedly breaks them.

10. The law that applies

These terms are governed by the law of Ontario and the federal law of Canada that applies there. If you're a consumer, you also keep the protections of the law where you live, and can bring a claim in your local courts.

11. Changes to these terms

If we change these terms, we'll update the date at the top and tell you in the app before a change that matters takes effect. Questions: support@animates.me.
